kind with a minor (who happens to be 16). Will this person go to jail or prison?
So even if the minor wasn’t forced

Depends…Was it consensual or was it rape? Usually if its consensual its not a big deal because no one really knows. If the parents find out though they usually press charges for statutory rape. In some cases if the guy hurt the the girl emotionally or they broke up she has been known to file charges as well.
Seriously as a cop I have to do my job, so if charges are filed I’ll make an arrest. However, kids are having sex at age 14 now. 16 and 20 are common ages of couples as is. We were all teenagers at one time, we know what and who we did.

Some states 16 is legal.

Depends on the State. In most, though, 16 is a minor and 18 is an adult. Sometimes the differences in ages counts to, since there is a 4 year difference, he could be charged with a felony crime.

Call your local police department to be on the safe side. What state do you live in? Some states the legal consent age is 16 and other it’s 17. You would rather be safe then sorry.

It depends on the location and the specific facts of the case. With no priors and no aggravating factors, a couple months jail time is most likely. You *might* get probation but don’t count on it. There are exceptions; for example, in Florida almost all state level crimes get you sent to prison, even for what would be misdemeanors elsewhere.

It’s called statutory rape, or sexual assault, if intercourse didn’t occur. Depending on what state he’s in, probably 6-8 yars in prison for EACH convicted offense. So yes, it’s serious.

the guy may go to jail but if he is convicted of any sexual activity he may spend like 10 to 15 years but it kinda depends

Here in Canada; a 20 year old having sexual relations with a 16 year old is illegal. If the person kissed, had oral sex, fingered, felt up the girl he’s looking at a minimum of 14 days in jail if the crown trys the case as summary and a minimum of 45 days in jail if the case is tried as indictable. If he had sex with her it’s sexual assault and it carries a max penalty of 10 years. He will get some jail time (14 days-2.5 years), 2-3 years probation; with conditions such as not being allowed in the company of anyone 16 and under, not allowed to go to public schools, parks, swimming areas. He will probably not even be allowed to have any contact with the victim in anyway and may be court ordered to have a psycholoigcal evaulation.

Prison will certainly "enjoy" you

I just saw something like this on 20/20. Even if the sex is consensual and the girl/boy is considered a minor in their state the 20 year old will be a registered sex offender for the rest of their life and have to deal with the consequences meaning jail/prison time.
Even if they end up marring the person they never dismiss the charges, so this 20 year old or whatever age can have sex with their under age girlfriend/boyfriend and be in the same category as the old men raping 5 year olds as a sex offender.

If you are considering contacting the police, please know that the very moment that you phone the police, this will set into motion a scenario that will be irreversible – and will destroy this young man’s future, and perhaps – life. I am not exaggerating. If you truly believe that the girl was victimized (in the traditional sense – not the conventional sense), then that’s another story. But if this is just an age-related thing … why not just show him a copy of the law, which he probably isn’t aware of entirely (…and then watch his face grow pale, … if he comprehends what he is being shown). That would be enough to send him packin’ forever. He probably doesn’t realize that these laws are FELONIES, which will hang about his neck like a ball-and-chain for the rest of his life. And then, there’s the Sex Offender Registry. No one wants to hire these people – no one wants to rent to these people – and later when they become a Dad, their own children get to live with the grief of their Dad being on the Sex Offender Registry (schoolage children get on the internet and check, also)… and on and on I could go. Your single phone call could do – no, WOULD do all of that. It’s your decision – but PLEASE – first read the linked articles. There are hundreds of articles to be found like these — these just happen to be very recent (ABC News; 20/20).
